UUUK4063 Reflection Post III

MY APPRECIATION POST TO MY CIVIL PROCEDURES LECTURERS


First and foremost, I thank Allah for giving me the chance to learn from the best lecturers. I am truly thankful for these past two semesters that we have gone thru together. I cannot thank all of you enough for all the experiences and  knowledges you have shared with us. With the help from three of you, Prof. Madya Dr. Shahrul Mizan bin Ismail, Prof. Madya Dr Safinaz bt Mohd Hussein and Dr Haniwarda binti Yaakob, we learn so much about Civil Procedure. Besides, we also learn about life.

With this opportunity, I am humbly and sincerely apologies for every mistakes made by me and my friends either by intentional or unintentional. I hope all the memories that we created during this year will be remembered as a happy memories forever. I wish that we meet again and please pray the best for us, as we always need for your blessing in our future career. Thank you very much. I will always missed you.

I decided to write about all these three assessments together since my opinion on these three methods is the same as these three methods are all beneficial to the students and I believed it should remained this way - compulsory to all students. Attendance to talks and class is very important so that student can understand properly; either from lecturer or lawyers about the subject.

Thru the reflective post, I believe improvement can be done in future. It's depending on the lecturer, since this is only my opinion and may not apply to the other students too.


UUUK4063 - Reflection Post I

1) Interview Simulation


It was the first assessment that we had to go thru. This is an individual assessment and I am in the first group to do the interview with Prof. Madya Dr Safinaz bt Mohd Hussein.

It may not apply to the other student, but the tense was really real 😅. We were encouraged to master the past Civil Procedure 1 as a preparation to attend the interview. In my formal black and white attire, I nailed my interview. Joke 😂 I was too nervous to even breath. I can't think straight and mumbling thru the entire interview. Beside answering the interviewer question, we were also given the opportunity to ask any question (just like any real interview). At the end of the interview, the Dr Safinaz pointed out our weakness, so that we can improved and apply later in real interview that we might attend later in future. And my weakness was....TOO NERVOUS.

Well, i fully believed that this interview does help me preparing myself for the real interview. I just done my interview for pupillage, and by learning from my past mistake that overly nervous isn't really a good friend, I told myself hundreds of times to chill and keep calm while answering all the questions. This mode of assessment maybe doesn't help much with the Civil Procedure knowledge 😅 but it helps me in another terms.


2) Talent Based Assessment

6 weeks before the due date, we was asked by Prof. Madya Dr. Shahrul Mizan to list out 3 of our talents, and my list was cook, gaming, reading, and presenting ( yes, I listed 5). After one week, Dr. Mizan put us in group according to our talent. The instruction was to pick any topic from Civil Procedures and relate and expand it by way of our talent (chosen by Dr Mizan). And guess what my talent is...??! COOK!!!

Teamed up with 3 other students, we seriously believed we were cooked up. How are we going to interpret Civil Procedure into cooking? But I guess that's why creativity is one of the most wanted criteria by the employer out there. After 5 weeks of hustle with the idea of cooking, we then decided to cook SOTO, or u can called it as Bihun Soup 😆😆.

Some students need to dance, some were singing, writing, creating game, doing mooting, acting, and we need to cook. My opinion regarding this mode of assessment? I'm sorry, but this mode seriously doesn't help much as a Civil Procedure learning process. There are lots of weakness with this type of assessment and I can point out about the finance issues, time consuming and the pressures that we had to face just to prepare ourselves for this assessment. I believe in classical mode, where the lecturer teach us normally in class. But, who knows,, maybe it's just me that doesn't suitable with this mode. we were having fun, but I believe that at the end of the day, the knowledge is the only matter, right?


3) Pressure Assessment

For this mode of assessment, we were given 4 hours to complete list tasks given. The task given to me was (1) prepare and file SOC, (2) File for subpoena (3) Prepare and file order and judgment for SJ (4) Attend a one sided PTCM - the opponent unable to attend (5) Write a legal Opinion (6) Meeting with senior partner. I manage to only complete 3 over these 6 tasks.

In my opinion, this mode is actually really good for students. Not only we can learn about Civil Procedure theoretically, but we can actually feel how the world works. We learn so much about time management, stress management, drafting, and doing works efficiently. I really suggested this mode of assessment to all the lecturers out there. It may be quite hard on the student, but if it is easy, then we won't learn.

Real lawyer were called to advice us, so we can learn from the real lawyer. I was very satisfied about this thing. The lawyers was very nice and I'm glad that Dr Shahrul Mizan doing this method of assessment on us.





UUUK 4063 CIVIL PROCEDURE II - Introduction

During  the second semester of 2018/2019 session, students are bound with few methods of assessment. The methods are
1) Interview simulation
2) Talent based assessment
3) Pressure assessment
4) Attendance during classes & talks
5) Reflective post about this subject.
6) Final exam

Each and every methods has its own advantages and disadvantages and I'm going to share my opinion regarding each of the methods above in my next posts.

MY SELF REFLECTION



Things that I learned through out this subject covers so many things. First, I learned a lot regarding procedures to apply for summary judgment. I never knew that in a Summary Judgment hearing, the defendant need to prove that there triable issues and the suit cannot be decided without calling for witness.  Besides, my group was specially exposed to another interlocutory application, which is the striking out application. The opportunity given by Prof Madya Dr Shahrul Mizan is very valuable and I'm so proud that I can learned about it earlier.  I did my industrial training at Majlis Bandaraya Alor Setar, so I didn't had much disclosure related to Civil Procedure. I am more fortunate since I am also the member of the court committee so I have the opportunity to learn more closely with another committee member from Prof. Madya Dr Shahrul Mizan.


Second, I learned a lot from my friends. Being one of the member of Firm 3 make me the luckiest person in my batch. Each one of my firm mate is very helpful, hard working, clever and responsible person. Anytime I don't know anything,I can just asked any of them and they will always explained it to me. Working in a group also teach me to always complete my task earlier than the due date. Moreover my clumsy and negative attitude will also affect them. Besides, the most valuable thing that I learned from my friend is always be positive and try my best to adopt with the new people and surrounding as people and surrounding will never adapt themselves around me. 😂

Third, this subject teach us to manage our time wisely. This is due to the date of filing, date of hearing and the time limit fixed by the Rules of Court 2012. As an addition, I'm becoming a more thorough person since any errors on the documents or procedures will great impact on the lawyer in real practice.

In a conclusion, I learned a lot thru Civil Procedure, under the guidance of Prof Madya Dr Mizan, Dr Haniwarda and Dr Syafinaz. As their student, I am so proud and so excited to learn more from them. Thank you.💓

THE LEARNING PROCESS

For Civil Procedure I, Prof. Madya Dr Shahrul Mizan have taught us using the learning approach of 'learn from mistake'. Using the method, we were assigned to manage two different cases for civil suit. The methods would be exactly like the real practice, which we need to commence the legal suit by using the method of writ summon. During this semester, we were required to apply for an interlocutory application which is the SUMMARY JUDGMENT (Penghakiman Terus) At the end of the semester, we are required to undergo a hearing for the purpose of the interlocutory application.

My group's first case was Quick Commerce Sdn Bhd v Easy Transact Sdn Bhd. This is the civil suit to claim for the repayment of loan that was lent to the defendant for the purpose of the defendant's agent interest.  This case was heard by Dr. Haniwarda bt Yaakob in acting as the Senior Assistant Registrar of Subordinate Court. 


While for the second case, we maintained that the plaintiff's (Golden Years Insurance (M) Bhd) claim against our client (Shahril Azmin) to pay all the bonuses that he have received over the employment period as unreasonable and unjust. The case was heard by Prof Madya Dr Shahrul Mizan in acting as the Senior Assistant Registrar of Subordinate Court. Fortunately the Summary Judgment application was rejected as the plaintiff failed to prove that this is a clear cut case and we (defendant's counsel) managed to raise several triable issues.

The hearing was indeed one of the most thrilling things in my life, but Alhamdulillah and thanks to my firm mates, we managed to get through it 👏

THE BEGINNING OF UUUK 4053 - CIVIL PROCEDURE I 


My group is known as Messrs. Firdaus Zakaria & Associates (Firm 3) consists of lovely members under the supervision of Mr. Firdaus Zakaria who is an alumni of UKM (Batch 15). 




Our Civil Procedure I journey started in 12th September 2018 where we are required to attend an induction course that was held in Bangunan Pengurusan Akademik, UKM. Through the induction course, we have been brief on the subject by Prof. Madya Dr Shahrul Mizan bin Ismail; as the coordinator for this subject.

I have been selected as one of the court committee, whereby the committee will be responsible for checking and receiving file (for the purpose of filing and drafting course paper) through out the semester.

We have been reminded that most of the tasks to be given must be done by group. Hence it is recommendable that we maintained a good relationship with our firm mates. 😉😉
